How Does Florida Amendment 3 Affect Viera Property Taxes?

Florida voters approved Amendment 3 with about 62% Yes. For Viera homestead owners, the nonschool homestead exemption rises to $150,000 in 2027 and $250,000 in 2028, then adjusts for inflation. The non-homestead assessment-increase cap drops from 10% to 5% for nonschool taxes. School exemptions, Save Our Homes, and portability stay the same. Changes start January 1, 2027.

Did Florida Amendment 3 pass, and when does it start for Viera?

Yes. Official results on Florida Election Watch show Amendment 3 with 4,917,796 Yes votes (61.98%) and 3,016,195 No votes (38.02%), above Florida's 60% threshold for constitutional amendments. The Florida Department of Revenue's Property Tax Oversight bulletin PTO 26-21 (November 5, 2026) confirms the amendment takes effect January 1, 2027 and first applies to the 2027 tax roll.

Florida Realtors summarized the measure after the election: larger nonschool homestead relief, a lower non-homestead assessment cap, and no change to school tax exemptions, Save Our Homes, or portability.

How does the Viera homestead exemption change under Amendment 3?

The increase applies to nonschool property taxes only. Per the Department of Revenue bulletin and the Florida Division of Elections amendment text, the homestead exemption for nonschool taxes rises to $150,000 in 2027 and $250,000 in 2028, then adjusts for inflation. The school tax piece of homestead stays on today's structure. Save Our Homes and portability are not rewritten by Amendment 3.

2027Up to $150,000Unchanged by Amendment 3

That exemption reduces the assessed value used for nonschool millages. It is not a cash rebate of $150,000 or $250,000. Your bill still depends on assessed value, Brevard millage rates, and non-ad valorem charges. Do not invent a dollar savings from a communitywide average. Look up the address on the Brevard County Property Appraiser site once you have a candidate home.

What if I move to Viera after December 31, 2026?

Timing matters for out-of-state buyers and anyone establishing Florida residency after that date. The amendment and PTO 26-21 state that people who are not Florida residents as of December 31, 2026 receive the existing homestead exemption when they first qualify, with eligibility for the increased exemption beginning with their fifth year of exemption, to the extent permitted by the U.S. Constitution.

When you first qualify, plan on about $25,000 for school taxes and up to $50,000 for nonschool taxes, then the larger nonschool path starting in year five. Establishing residency and filing homestead are separate steps. You still must make the home your permanent residence on January 1 and file on time with the Brevard County Property Appraiser. Keep residency records such as a Florida driver license, voter registration, and utility bills. My Viera homestead exemption and portability checklist covers the file to keep after closing, and the moving to Viera guide helps you map the relocation calendar before you fix a tax assumption.

Does Amendment 3 change CDD or HOA costs in Viera?

No. Amendment 3 rewrites homestead and non-homestead assessment rules for ad valorem taxes. It does not rewrite Community Development District assessments, homeowners association dues, or other private ownership charges that show up on many Viera ownership budgets.

In Viera, buyers often stack millage, CDD assessments, and HOA fees on the same address. Amendment 3 can change the homestead and assessment-cap pieces of the tax story, while CDD and HOA lines still need their own document review. Pair this post with my costs, insurance, HOA, and CDD page and the Viera CDD assessment tax bill checklist so you are not mixing those buckets when you build a monthly payment estimate.

How should Viera new construction buyers estimate property taxes after Amendment 3?

Budget from your projected assessed value and exemption path, not from a model home flyer or the seller's current bill. New construction assessed value typically resets to just value for the finished home, so a prior vacant-lot tax bill or a neighbor's capped homestead bill is the wrong planning number.

Ask your lender for an escrow estimate that uses your expected assessed value, your residency and homestead timing, and the millage for that parcel. Confirm flood zone and insurance quotes for the exact lot. My Viera new construction property tax estimate guide walks through those address-level checks. If you are touring builders, get your own representation and contact me before the first visit so I can set up the builder appointment. The builder's sales team works for the builder. Start with the Viera new construction guide and the buying in Viera page before you lock a lot deposit.

What about Viera rentals, second homes, and non-homestead property?

Non-homestead property does not receive the homestead exemption, before or after Amendment 3. What changes is the annual assessment-increase cap for nonschool taxes: it drops from 10% to 5% beginning January 1, 2027. The cap still resets after a change of ownership or control, so a buyer should not assume the seller's capped assessed value carries over.

That matters for a Viera investment home, a seasonal second home, or a non-homesteaded townhome. School taxes continue under their own rules. Model holding costs with the 5% nonschool cap in mind, then verify the parcel on bcpao.us rather than guessing from a headline.

Will my Viera tax bill go down because of Amendment 3?

Nobody can promise a lower bill on a specific Viera house or townhome from this post. Your TRIM notice reflects assessed value, exemptions, millage set by each taxing authority, and fees outside the exemption. Local budgets and rates can also change as the new rules take hold.

What you can do now is look up the parcel on the Brevard County Property Appraiser site, ask for a parcel-specific estimate once official 2027 guidance is posted, and budget escrow from your expected assessed value rather than from a model home sheet or a seller's current bill. What should Viera buyers and homeowners do next?

  • Current homestead owners: Confirm your exemption is on the parcel record. Watch for Property Appraiser notices about the 2027 roll.
  • Buyers closing soon: Do not budget from the seller's tax bill. Ask your lender for an escrow estimate on your own projected assessed value and exemption path.
  • Out-of-state relocators targeting 2027: Note the December 31, 2026 residency date. Ask the Property Appraiser how your move-in and residency dates affect the larger exemption timeline.
  • New construction buyers: Price the finished home, not the lot bill. Get your own representation and contact Carrie to set up the builder appointment before your first visit.
  • Investors and second-home owners: Model the 5% non-homestead cap into holding costs, and remember it resets at sale.

As a Brevard County Relocation Realtor working Viera relocation and Viera new construction, I hear the Amendment 3 headline first, then the calendar question about whether a 2027 closing gets the larger exemption right away. Residency date, homestead qualification, and the fifth-year rule matter as much as the headline numbers. Questions about a specific Viera address or move timeline?
