When is an earnest money deposit refundable on a Viera home?

A Viera earnest money deposit may be refundable when the signed contract gives the buyer a valid cancellation right and the buyer follows its deadlines and notice requirements. Refundability is not automatic just because financing, an inspection or moving plans change. Read the actual agreement and obtain legal advice before relying on a refund.

What determines whether your Viera deposit comes back?

The signed purchase agreement, its amendments, the reason for cancellation and the buyer's compliance with required notices determine the refund question. Sending earnest money does not create a universal right to change your mind. Before making an offer on a Viera resale, quick move-in home or proposed build, identify which payments are required and which contractual protections actually apply. This is general education, not an interpretation of your agreement.

Is earnest money the same as the down payment?

No. The National Association of Realtors consumer guide to escrow and earnest money distinguishes the good-faith deposit from the down payment. A deposit is usually held under the purchase agreement and accounted for at settlement if the sale closes. Ask the closing professional how the funds will appear in your transaction rather than counting them twice when planning cash to close.

Build a payment list before signing: initial deposit, additional deposit, inspections, appraisal, remaining closing funds and reserves kept afterward. Give each payment a recipient, due date, funding method and written refund rule. For a Viera home with association approvals or district costs still under review, the deposit schedule should be understood alongside those outstanding questions, not separately from them.

Which contract provisions should you read before funding escrow?

Find the effective-date definition, deposit delivery deadline, named escrow holder, inspection provisions, financing requirements, appraisal language, title provisions, default section, notice section and dispute procedure. Ask how days are counted and how notice must be delivered. A reminder on your personal calendar is useful, but it does not replace the agreement's method of performance.

Have Carrie organize an action sheet that pairs each deadline with the information needed to make that decision. For example, the buyer may need an inspection report, insurance feedback or association documents while an early review period remains open. Use the Viera buyer roadmap to coordinate the purchase. Do not assume that a missing quote or late document automatically extends a deadline.

Before offering a larger deposit to strengthen an offer, ask what happens if the appraisal, financing or property review does not support the purchase. A stronger financial signal is not a substitute for an affordable risk level. Deposit size and contract protections are separate negotiating decisions.

Does an inspection concern or loan denial automatically trigger a refund?

No single outcome answers every contract. An inspection-related cancellation depends on the language and timely exercise of the applicable right. Financing provisions may require an application, cooperation, documentation, notice or another defined step. Appraisal protections can be separate from financing protections. Ask an attorney to explain the exact agreement before assuming that an unfavorable result releases you from performance.

Viera buyers should pay special attention when several reviews run together: roof documentation for an insurer, association records for a lender, and the tax or district assessment file for the household budget. Discovering a cost later than expected does not necessarily create a cancellation right. Start the address-specific ownership-cost review early enough to inform decisions under the actual contract.

Why does the identity of the escrow holder matter?

Identify the legal entity holding the money, its contact information and the release procedure. A title insurance agency, real estate brokerage and attorney's office are not interchangeable regulatory settings. The Florida Department of Financial Services title-insurance overview describes title-agency escrow and notes that return of funds when a transaction fails requires written approval from both parties. A cancellation notice and an actual disbursement are therefore different steps.

For funds held by a real estate broker, Florida DBPR explains the broker's obligations when buyer and seller both claim a deposit. That broker procedure is not a promise that every title-company dispute follows the same path. If the parties disagree, seek legal guidance promptly and retain the contract, notices, delivery evidence, receipts and correspondence.

Are Viera builder deposits handled like resale earnest money?

Do not assume so. Request the builder agreement and every payment addendum before paying a reservation, homesite, structural-option or design-selection amount. Identify which payments are deposits, which purchase options or upgrades, where each is held, and what happens after a change, delay or cancellation. A sales-center explanation should match the written documents.

Compare the payment risk with the construction timeline. If your move depends on selling another home or starting a new job, disclose those dependencies to your lender and attorney before signing. Review the Viera new-construction guide for contract, inspection and completion questions. Neither a familiar builder name nor a completed model home determines your agreement's refund terms.

What should you confirm before sending the deposit?

Verify payment instructions through an independently established contact, confirm the escrow entity against the agreement, and obtain a receipt identifying the property and amount. Never treat an unexpected email with changed banking details as sufficient authority. Keep the payment record secure, then ask the closing professional to reconcile the deposit credit when reviewing final settlement documents.

A practical next step is a short pre-offer conversation with Carrie and, where necessary, your attorney: what must be paid, when it becomes exposed to risk, what decisions remain open, and how a valid cancellation would be documented. Equal Housing Opportunity. Guidance is available to buyers without preference based on protected characteristics; property and contract facts require individual verification.

Deposit follow-up questions

Can a buyer choose any earnest money amount?

The amount and payment schedule are negotiated terms subject to the accepted agreement or builder contract; there is no single deposit amount that fits every Viera purchase.

Does cancellation mean the money returns immediately?

No. A valid cancellation, agreement on entitlement and the escrow holder's release process are distinct steps, and a disagreement can delay disbursement.
